Damart Catalogue - Can they do this (I'm guessing they can :-( )

Sick to death of Damart emails and catalogues. Bought one thing, returned it and now cannot get off the mailing list despite numerous requests. Will NEVER be tempted to buy from them again.0

Damart products are overpriced and the quality of some of the products are appalling. An example is a clock they sell with a secret compartment to hide valuables. The hinge is cheap plastic which soon snaps the metal pin that holds the clock body to the base is loose and drops out and the clock doesn't line up so it doesn't shut properly so keeps opening. Clearly not fit for purpose. This company also owns coopers of stortford who have and appalling reputation for not sending goods and poor aftercare. Damart also in parcels put catalogues from brightlife uk to which I have posted on here about failing to supply goods paid for. One free gift was not in the parcel. For a company that sells to seniors who maybe vulnerable steer clear!0

Whether legally you need to return them is what was in the original terms and conditions - if it does not specifically say "buyer to pay for return" or similar then you don't have to - it is their responsibility to arrange collection, but usually people are happy to send back. If you don't want them (for whatever reason) you are allowed a full refund including any delivery costs.
As far as I understood the law the refund and return of goods are not actually linked. They are legally bound to refund you and it seems this is not related to whether they get the goods back or not. If in their terms is say "buyer to return" or whatever and you don't then this is a separate matter which they would need to pursue separately .0 -
yes you do need to pay for the return :
from their terms :
Right to Cancel
Under The Consumer Protection (Distance Selling) Regulations 2000, you have the right to cancel any items ordered (excluding personalised items) within 8 working days (Monday - Saturday) from the day after you receive your goods. Any monies paid, including initial postage and packing costs, for the order will be refunded within 30 days of cancellation. If you exercise this right to cancel you must immediately return the relevant items to us at your own cost. Top^0
