MOT and Car Insurance

Does anyone know the actual legal position regarding fully comp, protected bonus car insurance, following a bump, (driver's fault) in the situation where the MOT has expired within a couple of days due to simple oversight.
I have heard conflicting views as to whether the Insurers will pay either the other parties costs, or the Insureds costs.
I see the Highway Code says that the Insurance becomes invalid without MOT for driving purposes, but I have seen articles that say that providing the vehicles condition did not contribute to the accident, that the Insurers should pay out the claims.
Anyone know if the Insurers are obliged to settle the claims?
Thanks.

They would have to settle the third party's claim as they are the RTA insurer of the vehicle however if they can legitimately void the policy for the MOT issue then they would be entitled to recover their losses from the policyholder.
As to if the lack of an MOT invalidates your insurance or not really has to be handled on a case by case basis and is not a simple one size fits all answerAll posts made are simply my own opinions and are neither professional advice nor the opinions of my employers

If you can somehow show that you were going to an MOT test center, everything will become legal again.Happiness is buying an item and then not checking its price after a month to discover it was reduced further.0

I am proud to be dealing with my debt!
just one day at a time, dont take on ANY NEW debt.0 -
A statement supported by some individual's bad experiences and yet strangely not outweighed by the thousands of claims paid every day without quibble or fuss.
A silly statement, particularly in light of the thread subject.0 -
I will ignore fififofum's rather outdated view on insurance companies.
Unless the car is written off the insurers would have no idea as to if the MOT had run out or not. For an accident case with the majority of insurers they would not ask if there was one in force.
I know some insurers who MAY decide not to deal, particularly if the vehicle was in a poor state of disrepair and others will deal and deduct the cost of an MOT certificate from any settlement!!
Most policies will state you must keel the vehicle roadworthy - dont forget an MOT only shows road legal on the day it was issued.
