Dixons have not said they would take it in.... Samsung have. Dixons are not taking any responsibility for this product under any terms.
Un-technically it is still within the 6 months (Jan 20th 2012)
I have spoken with Consumer Direct twice, they have said I should only deal with Dixons and not Samsung. Once Samsung take the player away, fix, replace or whatever, then Dixons will no longer play any part in dealing with me. Any further problems would have to be taken up with Samsung directly and even if the item was eventually replaced by samsung the original guarantee would not be valid with Dixons.

So Dixons never told you to speak to Samsung? Samsung did? You see how it gives the strong impression Dixons told you?
As for the un-technically part, i did say technically if its been over 6 monthsUnder 6 months the burden is on the retailer to prove it wasnt inherent.
As for any further problems having to be taken up with Samsung, I dont see why this would be the case....unless Samsung damaged the item. Theres nothing in SoGA stating that by getting someone else to look/work on it that you lose your rights. In fact, if you were to get Samsung to look at it (or even anyone with satisfactory experience/qualifications) to provide a report of what the fault is, by the advice you were given from CD....this would invalidate your statutory rights. Thats not correct.
It can muddy the waters, but it does not remove your statutory rights. And IMO if they have told you it would remove your rights under SoGA, they are 100% wrong. Otherwise warranties would negate your statutory rights also (which would be funny seeing as you could argue the warranty forms part of the contract between you and the retailer.....since you specifically bought a item with a - for example - 12 month warranty) and given how usually SoGA is more favourable to the consumer, I imagine would be a loophole the government would have sewn up by now.You keep using that word. At least they (Trading Standards) will tell me what Consumer Protection/Acts to quote when I have to call Dixons again.
