parking eye paking ticket

I recieved a parking ticket from parking eye, my car was parked in Morrisons and overstayed the allowed time. I was not driving at the time so sent them a letter telling them this from the template on this site, however they have sent me a furter 3 letters and i have replied again saying i was not the driver and i am not obliged to say who is. Today I have recieved another one and they say that they need further evidence from me in regards to my appeal, although further correspondance will not be entered into unless it is to do with my appeal, further action will be taken if the charge remains unpaid. I phoned the BPA to complain about the continual letters and she told me that they were doing nothing wrong and advised me to tell them who was driving. If I felt it was harrasment then i should take it up with the police. anybody got any advice?

Just ignore them. They'll go away eventually.

I would ignore the actual letter, but separately if you get harrased like this, I would send the company harrasing me a 'Data Protection - Subject Access Request' and ask them for all the information plus images of your car that they hold.

Also ask Morrison for all the CCTV footage that you was using the store using a 'Data Protection - Subject Access Request'

If they dont give you the information within 40 days report them to the Information Commissioner’s Office, you may be able to get compensation.

    Also you could contact

    Trading Standards : tradingstandards.gov.uk/advice/index.cfm

    and

    Watchdog : bbc.co.uk/watchdog/gotastory/

You are not obliged to tell them who was driving the car.

Well, that just shows that the BPA has only the interests of their members at heart, when they give advice they are not quilified to do.
  • Ignore Parking Eye but inform Morrisons that you will be shopping at Tesco/Asda/Sainsburys in future.

I'd tell them who was actually driving - you may save yourself some hassle be telling them it was "Someone else" lol.

No seriously, a first name or last name only should suffice. At that point you've complied and its down to them to deal with it. Besides, there are all sorts of other legal issues to think about if you tell them who the real driver was, the DPA, breach of privacy/civil rights etc.

You're not under any legal obligation to provide the drivers details though. They're trying to assert powers they do not legally have. The only time they can legally extract the information from you is via a court order however by this point you'll probably have enough letters to accuse them of harassment.

Tell them it was Rover who was driving, so let them pursue a dog....

Complied? Complied with what? There's nothing to comply with - nothing that is mandated. It's just a request, which can be safely ignored.

Sorry, but that's complete bo*****s. You've been reading the Daily Mail too much. There is no civil rights issue at all, and no DPA breach, as there's no "data" held which is being released.

    That's more like it
  • Thank you to everyone for replying to me. However just been reading another parking eye thread and it appears they have taken someone else to court.
