Code 27 PCN Appeal

My brother recently received a PCN for a code 27 contravention (parking adjacent to a dropped kerb). He was parked on a street corner blocking a pedestrian access DK. He was parked on his own street where he pays the council £70+ per year to park but since the road has about 3 parking bay suspensions active at the moment combined with the fact parking is scarce at the best of times, he returned home from work late one night and had no option but to park there. There was no double yellow or white line, just a single yellow. His road has controlled parking between 9.30-4.30 and since he parked there at 11.30pm he thought it would be ok to park there until the morning. He returned to move the car at 7.30am to find a PCN. I realise he doesn't really have a solid defence here but it seems a little unfair to me and I think the council should use their discretion. He lives on a small side road so it's not like many pushchairs/wheelchairs are on the road between 11.30pm and 7.30am anyway. What do you guys think? Is it worth appealing or should he just learn from his mistake and pay up?
