Hi there,
hopefully someone can help with this one. A PCN was received from Civil Enforcement Ltd reagrding a car parked in one of their car parks.
However, the parking charge was dealt with using their phone system, as displayed in the car park. There is evidence of a phone call, made to their number, that lasted for 4.01 minutes. 5 minutes later, the car left the car park, as stated on the PCN. The phone call was completed and not stopped half way through. It would appear that on checking bank account, no withdrawal of the parking fee was made.
As far as we are aware, the parking charge (£1) had been paid over the phone and that should be that.
A PCN has now been received saying that the charge was not paid. Our present thought is just to ignore the notice, and hope that if it ever went to court (unlikely), that the evidence of making the phone call would show that reasonable efforts were made to pay the parking fee and that their computer system was at fault for not withdrawing the parking fee.
Does anyone have any thoughts on this? Any advice greatfully received.

Ignore CEL they will just send you crap, but out of interest did you have to enter your card details over the phone, or was the £1 charged to your phone?0

If no payment was sent, you owe them one pound.
Whether you pay is up to you. You will receive threatening letters either way. CEL have never ever done court.0 -
I am pretty sure that I entered my card details over the phone. The way I see it is that they failed to take the money from my account-therefore its their problem, not mine.0
