Desperate! Can anyone with legal knowledge please help?

Thanks for even taking the time to read this far.

I need to know can a personal injury claim thats been undertaken on a no win no fee basis, be dropped by the claimant at a late stage, if they are willing to pay costs, due to illness and stress its not worth it!

    So far as the court is concerned, yes, no problem.

    However, your lawyer has presumably done a fair amount of work already, expecting to collect payment once the case is over and you have won. If you drop the case now there will of course be no question of winning, and so no pot of money from which to collect the lawyer's fee, so they might well ask you to pay them instead. So find out what would happen about this before you commit yourself to anything. Perhaps begin by telling your lawyer how difficult you are finding the process, and ask if they can find ways to make it less stressful for you.

    Would you know if there is an average fee a lawyer gets for such a case, and also will the other sides fees need paying by the claimant?

    I'm sure Crazy Jamie will be long soon to give you accurate chapter & verse but in the meantime I'd have thought if you pull out then your own solicitor is going to want paying for the work they've done and the other side will want their costs if court proceedings have actually been issued.

    Overall I suspect that pulling out is going to be more stressful than carrying on and certainly it will be way more expensive
  • Your solicitor will have provided you a cost schedule and estimated total cost at the beginning when they did their case assessment.

    Typically you will be looking at about £150/hr with a few hours up front, 0.5-1hr for each letter written, .25-.5 hr for each call made/ received. couple of hours each time new evidence arrives etc. On top of the fees there will also be dispersements such as any GP or Consultants fees for preparing medical reports. If barristers have become involved it is then massively more expensive. I dont know what injury you are claiming for but even a simple whiplash case can easily be a few thousand.
