Help on withheld PPI refund

Hi
Can anyone help please. I have received a letter stating that i am entitled to a PPI refund, but they are using the money to off set against losses as the loan was entered into an IVA.
The IVA was settled in 2009, can they still withold this refund??????

Yes they can. Upholding the complaint means, in effect, they owe you money.
The IVA means you owe them money that you never paid them. So now they have an opportunity to collect it.
If you do not like this then pay back all the money they had to write off, plus interest - then ask for all the redress you are owed.0
