PCN Errors?

My son drives a company vehicle. He was allegedly caught by a camera in a bus only road. A PCN was issued by the council and sent to the registered keeper. My son responded to the PCN, declared himself the driver, and made a representation to the council. Needless to say the representation was, as expected, rejected.
But the letter of rejection and form for appealing was sent to the registered keeper. Additionally it was not sent for 76 days after the letter of representation and declaration by the driver.
Is this a technical failure in procedure by the council which my son could add to his appeal?
I would be obliged for views.

Include copies of all paperwork, all sides, remove personal data and see their stickies on how to post pics. A timeline would also help.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

They are only obliged to deal with the keeper. If you make reps as the driver, or appeal to the adjudicator, the keeper should sign off any reps. It's much easier if the driver acts as if they are the keeper throughout the process.0

Whilst I understand your point it seems odd that the council are only obliged to deal with the keeper when they have been informed who the driver was. After all in this situation the keeper knows nothing about the alleged offence. And how about taking 76 days to reply? This seems a long time when you are obliged to respond/pay in 14/28 days.
But then who says things have to be fair...........!0
