Vendor repairs

We had an offer accepted on a 1st floor Maisonette and after the survey came through with a few snags the vendor said he would do the work prior to us moving in, some of this work is the joint responsibility of the homeowner on the ground floor so the cost was going to be split in half.

Now the vendor has come back to us asking if he can give us an allowance on completion for the cost of half the work.

Now I feel we are stuck because there is no guarantee that the person on the ground floor will want to do the work. Is there any way of us getting round this our should we put our foot down and say no, we want to stick to the original plan.

  • 1. Shortening the height of the 2 chimney stacks in alley inc scaffold hire costs £1700.00
    2. Replace gutter above bathroom window & downpipe with upvc £230.00
    3. Mortar repairs to soft red brick side elevation wall where laminated £320.00
  • Insist seller organises the work in conjunction with other flat owner. If he can't get the other flat owner to pay half then how will you do so after you move in? What other issues will come up where you will need the agreement of the other flat owner? Do you want to move to an awkward neighbour?

    Walk away unless seller sorts it.

    I presume this is a leasehold; is there a management company looking after the building?
  • No management company but I spoke to our solicitor and she said that under the terms of the Lease it is the Landlord who covenants (subject to the payment of the service charge) to carry out the maintenance of the common parts - so I think that the Seller (who is also the Landlord here) should obtain the monies from the other lessee in the building, and carry out the works (on or before completion) – and as completion is scheduled to take place in February of next year he has ample time to make the necessary arrangements.

    So this is what we are going with.
