An ebay return - Faulty goods

Hi
I bought somthing last week (a phone protector/ cover) on ebay. It was supposed to be glow in the dark. However it doesnt glow in the dark even after hours of being 'charged', also it has some internal sharp points which means it could scratch a phone rather than protect it.
They are a business seller if it makes a difference.
I emailed them last Wednesday morning and didnt recieve a reply so escalated it today on ebay, and they sent me a reply tonight. They say they will refund the money I paid if I send it back, but I have to pay for that.
Surely that isnt right, its both not as described and unfit for purpose. Shouldnt they pay for it to be sent back?

If rejecting under sales of goods act yes they do.
If returning under distance selling regulations it's likely you do (depending on their terms).
Based on what you say it seems you would have grounds to reject it -- however, realistically ebay before refunding you will demand you return the item to the seller. So the small matter of recovering the costs of registered post is left with you -- and since it's likely to be a very small amount and therefore going to small claims is unlikely, leave negative feedback and move on0 -
They should if it's faulty but ebay won't make them so if they refuse there is not a lot you can do except small claims court, hardly worth it for a couple of quid though.
Remember to send it back by a trackable means and upload the delivery signature to the ebay complaint so they can't say they never received it.
There may be some tips you can use if this gets moved to the ebay board, someone may be able to advise you on how to get ebay to pay the return postage for you.0 -
Yeah im returning it under the SOGA for being faulty and not fit for purpose.
I just dont see how it is fair for me to pay return postage costs when legaly they have to. They cost of returning it would make it not worth my while. Its more principle than the cost.0
