Need help with private parking ticket

Hi folks,

I was wondering if anyone can give me some advice.

I live in an appartment block, which has a car park that is secured by an electronic gate. Each appartment is given a specific parking space within the car park. In the last month they have introduced permit parking.
About a week ago, my friend parked in my designated parking space, but I completely forgot to give her the permit so she could display it. Of course, within 1 hour, a ticket had been issued.
In fairness the car park is well sign posted, but do I stand any ground for winning an appeal. I have already being denied the first appeal, but really feel I have been hard done by, especially because our rent contract doesnt mention parking permits etc.

I really appreciate your advice.

    As this is a private parking ticket you don't have to do anything from now on. Do not contact the company again and ignore any correspondence from them. As they can only claim for the actual material loss suffered by the landowner ( in your case £0.00) then you don't owe them a penny. For further reassurance please see all the other threads on here that deal with private parking tickets.

    Just ignore it and all the threatening letters that follow.

    Instead, take your managing agents to task over employing these predators in the first place - Especially if there is nothing in your contract. Is the parking space included in your lease? If so, doubly this! :)

    You need to dig out the flat's lease and post the exact wording here. You may have to ask your landlord if you are renting. All the flats should have the same lease, so alternatively try an owner/occupier neighbour. Do you have a Facebook group?

    If the lease states you have granted rights to use the space, the parking company has no rights over the land and the management company has no legal right to employ them outside communal areas. In this case you should inform the management company in writing that you opt out of the scheme and have no legal necessity to demonstrate you are not trespassing on land your lease grants you the right to use.

    You certainly shouldn't be 'appealing' these unenforceable invoices. They're always going to turn 'appeals' down - it's a con.

    Simply ignore them.

    This is a common situation with management companies who overstep their legal powers.
  • As AlexisV post, this comes up quite a bit and in probably 95% of cases the flat lease hold grants the use of a car parking space within it. This means, as AlexisV post, that this is YOUR space and unless they vary the lease, they can't ask you to do anything and they certainly can force a permit system on you in your space. Anyone you authorise to park in your space equally, can not be forced to use a permit. They can only legally be asked to enforce parking in communal areas.

    This usually comes up when someone gets clamped in their own space, so in that regard, you at least have nothing to worry about, your friend can just ignore the PPC invoice, like all PPC invoices... nothing will happen!

    The car-park is secured with a gate so why on earth did the management company bring in the parasites?

  • PPC parasites pay a nice little backhander to landlords and their agents who grant them bountyhunters rights on a car park. It used to be £10 per bogus ticket that was paid by the victim.
    Still waiting for Parking Eye to send the court summons! Make my day!
