On deeds but not mortgage. Can I claim MI12?

    Thank you :) My situation is grim enough without feeling like a drain on society to boot! Nevermind...nearly Christmas! :eek: ;)

    Ignore the troll that has infested your thread and enjoy this and every christmas you have left with your bairn, my kids both have disabilities but they are both far from their sell by dates at present and I thank god for that each and every day.

    I guess that hearing someone can get help from the DWP when he couldn't has wound him up a bit? ;)

    Sorry if I confused. I was answering the point where someone talked about claiming SMI when they had lent someone a house deposit and registered the loan on the deeds. Given that the lent Monet with no interest to pay there was clearly no SMI to claim.

    Back to OP. another option would be to see if social services can help. Explain to them that you cannot afford the mortgage on the property you live in and you may be forced to move if the property is repossessed. You will then need the adaptions to the new property made to enable your son to live safely in the property - unless they can help you claim SMI.

    Another thought, is it possible to get your name added to the mortgage? Obviously this creates a liability for yourself, so consider carefully.

    Third thought, if the property is sold, you should get half the equity (the amount after the mortgage is cleared) would this be enough to pay a deposit on a decent rental, or even buy?

    Fourth thought, if the property was repossessed, would the council have an automatic responsibility to rehouse you (given that it wasn't your mortgage arrears that caused you to lose your home)?

    It's ok Silvercar, I think the fact that tatonette brought their own issue into this thread caused the confusion :)

    Social Services are involved and have been from day 1 and I have explained I cannot afford the mortgage, even if HSBC would allow it. I can barely afford to heat it either but that's another issue.... I would love to move but suitable housing for the disabled is very very scarce.
    I haven't even considered asking about being added to the mortgage as I assumed I would have no chance seeing as people with deposits and full time employment are struggling to get a mortgage.
    If the property was sold, that would be the ideal outcome for me for the reasons you stated, however I would still need the help of the Local Authority to adapt and as I said, I was advised that if I agreed to a sale then I would have no rights to be re-housed as I'd made us "intentionally homeless".
    If the property was repossessed I would hope the council had a responsibility to re-house us but from their point of view it is better for us to stay where we are as like I said, there are no adapted houses available which leads us back to them asking me to apply for MI12
    I've been round and round this situation since he first left but the issue has been forced since he stopped paying the mortgage and Social Services have been less than "on the ball" so to speak :s
