Beware M&S 3 for 2 offer

M&S has an offer 3 for 2 on toys. I added 3 but didn't get the discount at the end. I called M&S and they said it was a system error and some of the toys are showing as 3 for 2 but are not. This is false advertising, should they be honouring the offer?

    It's not false advertising, it's a mistake. If they quickly remove any promotional signs and demonstrate an effort to rectify it then I doubt they are breaking any advertising rules.

    You knew the total price though before committing to the purchase right?

    That would depend on whether you could reasonably have expected to notice that you had not got the advertised discount.

    If you had a basket of shopping that came to, say, £60 and the toys made up £9 of that, and you only realised the discrepancy after your had paid and received the itemised bill then, yes, they should reimburse you.

    If, however, you simply bought three toys and were charged £9 rather than £6 you should have queried it at the time.

    They still haven't rectified it and there are a few toys that look like they shouldn't be in the offer either. Luckily I didn't go through with the purchase, but I imagine there are people that wont check and get fooled into thinking they got the offer.

    If they continue to display a misleading notice, having had a reasonable time to correct the mistake after being informed of its nature, then they are guilty of false advertising.
