Bought a car now having problems with dealer

    It is called a trade in, because the part exchange is purchased IN on TRADE terms
    That is sold as seen with all faults and imperfections.
    They had opportunity to examine the vehicle which they did and offered a price based upon the inspection.
    I can not see them getting very far in a legal situation.

  • onus is on the garage taking in the vehicle to inspect and check the vehicle PRIOR to exchange.

    the garage can contact you or infrom you BEFORE money is exchanged to rectify any mis-given part ex quote and adjust accordingly to give the customer a chance to go ahead with the purchase or not, deposit should be refunded as the mistake is on the garages part.

    the garage had 2 chances to look and inspect the vehicle with you present start it drive it on look at the vehicle any faults is then discussed prior this didnt happen and as such is the garages failure.

    as for your car NOW they cant request you take it back and exchange more money for their mistake, your on the upper hand here, you can hand back the car for cash and deposit refund and take back your old vehicle in the condition as it was exchanged in, or simply keep it. your rights still apply with the garage and your warranty if you have one with them, though the garage can request you dont deal with them but to take it to xyz garage they have an account with if it ever goes faulty.

    Update is ............there is no update, nobody from the garage has phoned us and were hoping that is the end of it although I'm not holding my breath. DH phoned the legal helpline yesterday and they said much the same that has been said on this thread and in the first instance to stand our ground.

    Thanks to everyone who took the time to reply if I have any further news I'll let you know
