If the ex boyfriend's FB account is restricted then the LL simply opening her own FB account will not mean that she would be able to access his personal pages. Only his FB "friends" will be able to do that.
T should have insisted that the police recorded it as a crime and obtained a reference number. LL then claims on insurance policy. Sounds mighty like Plod not wanting the paperwork in this case.
If "rioters" can be hauled into court over the content of their social networking pages then so can other petty criminals. I should imagine that the ex has now deleted that original comment.
If the circumstances are that the ex BF randomly committed this act from the street then this person is not a "visitor" to the property in the usual sense of the term within a tenancy agreement. It's a nonsense to suggest otherwise. I would suggest to any T that they challenge a LL seeking to pull the costs back from the tenancy deposit in those circs.
Had he actually been at the property by invitation of the T, had a row whilst there and then kicked the window in on leaving the premises then I would however expect the T or her insurance to deal with it and be making their own decision over how to pursue the ex BF for recompense..
But on a bit of reflection over the other things we have learned about this tenant, I do wonder whether OP has actually been told the whole and nothing but truth.- Is there another explanation for the window being broken?
- Or more to it?
- Or the ex bf being stitched up?
- Could it actually have been tenant's ex, who might have a history but daughter's bf blamed, because no one wants a tenant with a problematic ex?
- Was it actually reported to police?
- Did the police actually advise as reported?

Hi, I will answer this and I do appreciate all the input given.
To clarify some of your points. This property is approximately 2 minutes walk from my home, I used to live there so know all the neighbours well including the tenants best friend who lives opposite and is also a friend of mine.
I do know that the things I have said are true, I saw the facebook page from the daughters account when I was called to the house. I have the log numbers for both incidents. The threats to kill and the threats to break the windows.
The tenant does not have an ex, she lives with the childrens father and they are both on the tenancy agreement.
The police are not known for dealing with criminal damage by children/youths where I live so I am not in the least surprised by them not acting on this.
I am happy to keep the tenant as I stated in an earlier post. I have had teenage daughters myself and remember how hard it was.Life is not the way it’s supposed to be. It’s the way it is. The way you cope with it is what makes the difference.0 -

I don't think that you understand the spirit of this forum. It is certainly not to offer ways to shaft tenants just because they don't know any better.
I don't think many would disagree that if this went to deposit scheme arbitration that the tenant would win comfortably (for good reason). They obviously don't know this and the LL is taking advantage which is his prerogative. In my opinion that is not money saving, its immoral.0 -

You say you have "log numbers" so presumably you mean that the police have in fact made a formal record of the incident, including the damage caused?
If yes, then your insurer should be coughing up and not the T. Yes, you may have a policy excess to pay but (a) this is what your insurance is for and (b) you can set that excess down on your tax form.
This part has to be dealt with separately from issues with boilers,leaks and paint on paths etc. IMO some posters seem to have decided that this is a "certain sort" of T and that she should therefore be punished more harshly for a misdemeanour not of her making, simply because it comes on the back of other issues which *were* apparently down to her actions/omissions0 -

Is the double glazed unit less than 800mm from the ground (inside or out) or in a classed dangerous position (within 200mm of a porch or door ) did it need to be toughened (was it) What have you been quoted to replace ??:cool: hard as nails on the internet . wimp in the real world :cool:0
