Does any one else remember a thread about just this not long ago?

I dont have that thread Handy though at present.

I was thinking the same, definitely rings a bell. Nevermind, I'm sure if we go with the flow it will come back to us! ;)

OP, who was ill at the relevant time - yourself or the child? If yourself, who was looking after your child?

I don't understand the first part of your letter. Is it some kind of computer geek talk?

I was the one that was ill. My ex's were looking after their individual children at the time. One of my ex's actually came to live in my home and look after me as well - God bless him.

So why could the ex not appeal the decision? As you clearly had someone managing the affairs of yourself and your children, it will be difficult to argue that the DLA decision could not have been appealed.

He is my Ex - not my husband! He looked after his child, the youngest and helped me with day to day things when he came home from work.

He wasn't there to deal with my legal affairs or those of a child that isn't his.

Besides which, it doesn't matter anymore, as the DWP have accepted that I wasn't able to appeal due to illness and have already superceeded the 2005 decision on those grounds and evidence recently submitted. The question of my ex being with me never arose, it was all based on medical evidence.

All I wanted to know was if I would get the past 6 years backpay?
Not that I need it, I just wanted to make sure that they hadn't made a mistake in not giving it to me.
