Atos Medical Assessment without ESA50

Just purely hypothetical.... 
Someone has been claiming ESA for the assessment phase, receives the ESA50 but doesn't fill it in.
Then receives an appointment from Atos for the Medical Examination, which is attended.
No mention of the 'missing' ESA50 is made by the HCP. They simply ask why the person is claiming ESA and then moves the assessment on from there.
What happens if that person then 'fails' the assessment? Obviously there is the appeal process.... but is it a factor that Atos didn't have an ESA50 to work from?

If the ESA50 is not required by the DWP, then the medical can proceed.
There are a number of conditions where not completing the ESA50 isn't an automatic fail, even if the DWP would normally require it.
If they fail to get ESA, the appeal proceeds entirely normally, with no difference, except the ESA50 will not of course be part of the evidence considered.
As they have had their medical - this short-circuits any possible sanctions for not returning the ESA50, even if it was required.0
