MBNA unsecured loan how can they register a restriction against the land of my home?

I havent been able to maintain the repayments after being off work for three months with serious illness. i have had a court letter and then recieved an "application to register a restriction against the land"

What does this mean? Also how can they do this when my credit card was unsecured?

Please help me

Sorry i put loan in the title it is in fact a credit card

    It may be unsecured, but they can still recover the money any way they can. In this case you have something of value, they will ask the court for a restriction on the land so you can't just sell it and run off with the money, the restriction could give them a charge on the land.
    You may be able to reject this claim, but you will need professional advice to represent you in court. This may be costly and may not stop the restricion.
    See if you can get a solicitor to give you advice with a free 30 minute meeting, to outline you chances of stopping it.
  • I agree wholeheartedly with bris but OP I feel you have missed out a large chunk of this story.

    There is no way you would be getting solicitor and court letters if you are just 3 months in arrears.

    you haven't given sufficient information for us to be helpful

    they are trying to put a charge on the house

    I would suggest you contact the free debt advice agencies CCCA, Payplan, Debthelpline, CAB

    you can get good advice and support on the debt freewannabe board (go there now and repost with full details)

    donot ignore the situation
