Internet purchase wrong item sent and restocking charge

    Visa debit card offers the same refunds / charge back as a credit card. Tell him if you don't get your money back with-in 48 hours your going to a charge back.

    It's like he has different rules and regulations from the rest of us, I've given up with him and I'm using Martin's letter to go for chargeback. I'll let you know how it goes. thanks

    You should be able to action a chargeback by phoning the bank -- might save the cost of a stamp :)

    UPDATE: I phoned Visa debit disputes and spoke to a lady who told me they could not get involved as the supplier's website said that they charged a restocking fee. I advised her that this was illegal under distance selling regulations and she checked with her manager who apparently was also unaware of this. She asked me to write in with evidence of distance selling regulations! I informed her that the item was also not fit for purpose, to which she replied I might wish to put that in my letter to them also. She then asked what a restocking fee was! I have put it all in a letter following Martin's draft. I'll keep you updated.

    While its sometimes saddening to hear how clueless some people can be, on the brightside think of it as your good deed for the day, you've informed 2 potential consumers of rights they didnt know they had :)

  • UPDATE: We received a letter from our bank today, asking for a copy of any order confirmation(this is the easy bit) and " a copy of an independent report from a reputable retailer of the same trade to confirm that the item was faulty or not fit for purpose" (not quite so easy). As the part has obviously been returned I can't do this part and so unless i want the hassle of the small claims court, I will need to put this down to experience. I won't be buying this type of thing online again!
  • Sounds like the small claims court is a lot less hassle to me
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    Perhaps try contacting your bank again and explain why you cant? Ask if they will accept anything else? Perhaps a letter from the heating engineer stating it wasnt the right part etc?

    Exactly this. I t would be unreasonable of the bank to turn this down.
