Statutory Maternity Pay.. Pregnancy related illness during 8 week calculation period!

Hi all,
Writing on behalf of wife her company pay statutory everything lol
She was off ill with a poor pregnancy related diagnosis during her 8 week 'qualifying' period. And what this has done is skewed her maternity pay down below the 124 pound threshold.
She didnt earn big bucks but was on more than 124 pounds a week for over a year, but it seems has been jipped because of being ill while pregnant.
From reading the government website it seems this is correct, and i guess it is but it doesn't seem fair.
Basically if you was ill for the 2 month period that they use to calculate SMP and not ill any other period then you'd only get 90% of Statutory sick pay for your entire maternity period. Luckily wife returned to work so overall impact isnt too bad.
She basically is going to get 121 pounds per week for entire period. Im sure if she had quit employment she can use her best '13 weeks' to calculate entitlement. Doesn't seem fair lol.
Basically heres calculations given to her by employer:
To calculate the average weekly pay you take the 2months salary prior to this date.
30th June £453.31 and 31st July £717.20 to find the weekly gross pay x 6 and / 52 = £135.05884.
She will be paid 90% of this for the first 6 weeks. £121.56 per week.
Her pay for previous periods was like 1085 pounds.... constant... and after this period too lol

It's a pain in the wotsit isn't it?! I was ill during my qualifying period too - and for most my pregnancy actually! There wasn't anything I could do about it
Best thing I can advise is to check tax credits, there's a £100 per week income disregard whilst on SMP x 0 -
This happened to me but I managed to factor in my annual leave so ended up getting my 90 per cent after some debate. Speak to HR.0

the ironic thing is if she had quit for example the other type of materity pay you can take your best 13 weeks during the entire period i believe... so would've got more if she had quit... or lost job. Doesnt sound fair lol, then again its only a few hundred quid.. so mweh.0

Stick all the details in http://smpcalculator.hmrc.gov.uk/SMP1.aspx and see if the work used the correct pay periods to calculate it. It wouldn't be the first time an employer has used the wrong payslips to calculate SMP.New PV club member. 3.99kW system.
