Help please with money claim online

Last Saturday I issued a money claim on line to someone that has owed me money since July. It wasn't for a great amount but that isn't the point. Today he has paid the amount he originally owed but not the £25 I paid to issue the summons. Surely he should have paid the full amount on the form ie the original amount plus the £25 fee. Where do I now go from here please.

    contact him to say he must pay the whole amount on the claim form or a CCJ will be issued adding another £35
  • Thank you. He has paid by paypal the original amount. Not done this before so all new to me. I will email him and say he must pay all of it. Do I need to do anything this end ie tell the courts he has paid some of it or no??

  • Of course I am assuming that he hasn't just miraculously paid from the numerous reminders I had sent, and that he would have received the claim by now? How long does it normally take to receive once issued?

    I emailed him yesterday and he is now asking me what summons!!! How can I be sure he received it, please advise!!

    Contact Moneyclaim Online and speak to them, they will be able to let you know when the summons was issued. It seems strange that the chap has only just decided to pay now via Paypal (don't forget you will also have your own paypal fees to pay so what you get from him will be less a bit for paypal fees). When you call MoneyclaimOnline on Monday, I would mention to them that he has paid some money but not the costs and take it from there.

    Thats what I was thinking Horace. Real coincidence that he has suddenly paid after months of reminders, the same week a summons has been issued. I done it last Saturday and on the website it is saying issued on 28th but I dont really know how these things work etc so thanks I will ring them tomorrow.

    Moneyclaim online are very quick to issue their summonses so if it was issued on 28 November then it is likely he would have got it pretty smartish.

    I used them when I had a problem with a very expensive ski jacket, the buckle broke the first time I wore it and I tried for months to get a response from the shop (I did not live local to the shop) so I claimed for the cost of the jacket plus my costs. I had some pretty foul phone calls from the shopkeeper and in the meantime she sent a far better buckle that was magnetic and metal instead of the flimsy plastic effort. She eventually paid up and demanded that I take the jacket back to her - I rang the court who told me that I was not to take it back as it would incur more cost and inconvenience to me but I should write to her and give her 14 days to come and collect it after which time it will be kept. She never collected it and now I have a lovely ski jacket albeit now with a rip in the back which has been repaired after a tobogganning accident.

    Hi, did you get a satisfactory outcome to this? I am a Maths tutor and I am owed £40 by a student's mother. I know it is not a huge amount, but, as you say, it is the principle of it. She has been promising me the money that she owes since April, followed by sob stories about her financial problems. Needless to say, I stopped tutoring her son after two lessons went unpaid. I spoke to her recently and she told me, bold as brass, that her son was going on a school skiing trip in the new year. This has made me quite angry and I am considering chasing the money owed through Money Claims On-line. Would you recommend this? Is it worth the hassle? Many thanks
  • ksm, send her a draft copy of form N1 and that she has 14 days to pay or the claim will commence on the 15th day.

    ksm - I wouldnt mess about with the woman, just use moneyclaim online and remember to add the costs for making the submission to MoneyclaimOnline. Let the court deal with her.
