Pcn help please.

Hi
On Sunday 17/07/11 I parked in a bay thinking it was free because it was a sunday, also there wasn't a sign close by so I left. When I got back I found a pcn on my windscreen.
The next day I wrote to them explaining what happend. Also the same day I left for my holiday for a month.
After I got back I found a letter from them asking me to pay the full amount. I contacted them and they said that they hadn't received my letter. So I resubmitted it on the 16/09/11.
I than received a refusal letter on the 12/11/11.
I read on MoneySavingExpert that if they don't respond within 56 days of receiving my appeal the penalty is unenforceable.
I counted and it has just past the 56 days, does this mean that the pcn is unenforceable?

You must be careful/quick to act here - it's not clear whether the second appeal you sent was treated as an informal or formal appeal (after the NTO 'letter' you were sent). If they treated it as a formal appeal then you do not have long before they start the enforcement procedure if their rejection was dated 3 weeks ago.

Pepipoo will help you with this if you are quick and start your thread this weekend. You may need to appeal to an adjudicator. The way they have processed your appeals may give you good grounds to argue there has been procedural impropriety.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
