IS there anything we can do?

On the 16th September we paid a deposit of £300 for a £3000 bike. We were advised it would take 12 days for delivery. Since then we have contacted the store every 2-3 weeks to ask for an estimated date of arrival and been advised the shipment has not arrived in the uk.
On the companies website it advises 3-4 days for delivery but we received an e-mail today advising the shipment won't be in the uk till the last week of December. Therefore if this is true (the last 3 dates have not been) then we would have paid 3 months installments and the deposit with no product.
Is there anything we can do? Or what can we say to the company to ensure to stop getting fobbed off with excuses. Also are we within our rights to ask for the deposit to be refunded?

Which company is it? A local one or a large national chain?0

Is only a small single shop based in Scotland. I was a mail order rather than visiting the shop.0

The finance was organised through a separate compnay not the bike company but the company arranged it.
The bike is a standard frame so no built to order.0 -
I'm wondering if you can make a section 75 claim with whoever the credit agreement is with claiming goods not received.0

Unless you have a contract with terms stating that you might not receive your bike for such a long time, I would have thought that this would be a simple breach of contract. You have agreed to buy the bike, yet the shop have not been able to supply one in a reasonable time.
For that reason I would ask for a full refund and threaten court action if I didn't get it.0 -
