Refused to exchange because they said I had swapped it?!?

I bought a PSP (along with a Wii and an XBox 360) from a Cash Converter/Generator type store called Simply Cash.

Took them home and tested them all (as they were all 2nd hand) and everything but the PSP worked fine, so my Girlfriend took the PSP back the following day with the receipt.

When she explained what had happened, the guy behind the counter took the PSP out of the bag, looked at it and said that it wasn't the same one and we must have taken it home and swapped it. Whats worse the serial number on the receipt did not match the serial number on the console so we didn't really have a leg to stand on.

Not sure if this was a genuine mistake on their part or a tactic to avoid having to refund/replace but it was not only embarrassing but really frustrating because I knew (and I secretly felt they knew) that it was the exact same console that we bought less than 24 hrs before.

To be fair we prob should have checked that all the serial number matched and more so that it worked before we left the shop the day before but we had been buying things from there ever since it opened and thought we kind of had a rapport with the owners/cashiers.

In fairness, the story does have a happy ending because after 30 mins of arguing and 3 visits back and forth to the shop the cashier did reluctantly agree to refund the money but it did get me thinking;

A) where we would have legally stood if things had not turned out in our favor - I couldn't help but think that if he had dug his heels in that we wouldn't have been able to do anything about it??

and B) It should be a cautionary tale for others who are buying pre-owned electronics for Christmas presents.

    When I sold expensive cameras online I noted the serial numbers of everything I sold. You would be surprised at the number of people that tried to swap their broken one.

    When I posted the items out I started to inclue the serial number to stop them.

    So it works both ways.
