Absolutely right. If an error has occurred, you would only have one receipt, you cannot prove you don't have the second receipt.

However, Primark can prove they have two retailer copies of the receipt. All they have to do is produce them.

I would be telling your bank the card must have been cloned and needs stopping immediately.
  • Even if there is two copies of the receipt, it wasn't an authorised debit and no goods have been taken.

I'm hoping when the complaint goes in, in writing someone will see sense and deal with it.

Branch staff are just flatly refusing to commence dispute/chargeback service. They say it was authorised and thats that. Absolutley shoddy service.
  • I would be seeking to obtain copies of BOTH the receipts that the STORE has.
I would then look at them in detail to see how they compare. If for example, the transaction times were both the same then something has clearly gone wrong. Either way, stick to a formal complaint with the store to try and get the matter resolved. If they were separate time then there's something fishy. Once you know the times you might be able to request their CCTV footage (that's if they keep it for longer than a week), which may cover the till area & show how long they were at the till for.

Hmm. Escalate through complaints processes and ultimately, take the bank to the small claims court? 2 Authorisation numbers means that they were asked to authorise twice. But it does not prove that the second request was not spurious.

surely it would be Primark you'd take to court? It is afterall them who have charged op twice and therefore have the money

Depends on the claim you wish to make. Primark for debitting twice or bank for debitting twice. A claim against the bank might get some evidence which exonerates the bank but implicates Primark. On the other hand there may be no such evidence. On reflection, I would be inclined to make the one claim against both.

I think I would plump for going through the Financial Ombudsman service after going through the banks complaints process.

Its free to the complainant but not to the bank, and doesn't take up their time going to court. Which they can still do afterwards if they so wish.

I think the telling fact in the OPs original post was that both transactions were at the same time.

My reading of bris' post is that he/she is a retailer. He/she is is talking about stopping chargebacks not applying for them.

I had this argument once with HBOS years ago (and refuse to use them again because of it). I noticed my account was overdrawn by a very large amount (several hundred pounds), I called them and queried the charge saying I hadnt authorised it and didnt have a clue what it was for. They told me the payment was made in person and had been authorised (pre chip & pin btw) and refused to even start a dispute/investigation even though I was telling them it wasnt an authorised payment.

The absolute kicker was that i live in central Scotland, the payment was made in England and I had used my card just 2 hours previous in a store local to me. When asking HBOS how i could have gotten to south of England from where i live in 2 hours, they replied perhaps I'd given my card details to someone............which was ironic given they'd just told me the transaction was showing that the card had been presented for the England payment AND the Scotland one. Why they authorised a payment that took me hundreds into the red i'll never know, I didnt keep money in that account. I only used to deposit what i was planning to spend.

It took me nearly 2 years to get them to remove the charge from my account. I realise a minority of people must claim they never made charges in order to try and get out of paying them. But when you refuse to investigate genuine cases where any idiot can see theres something not quite right, its taking the flipping mickey.

How the hell did it take so long to sort out? You don't need to be that bright to realise somethings not quite right!
