i have done remortgages for people with a second charge registered, as long as the company postpones their charge there should be no problem. but as you belive you can clear this by june the problem you are likely to have is the fact you have only recently cleared your CCJ so you will pay a higher rate0 -
HM Land Registry doesn't include the amount owing, but more recently they have started listing the amount paid for a property. When you took your second charge you should have written to the prior mortgagee to serve notice of your charge. This protects you in two ways:
1. They respond telling you how much is owed as at the date of your notice.
2. The amount of their borrowing is "crytalised" ie frozen at this level. Meaning that anything they borrow via company with 1st charge ranks BEHIND your charge.
These two points together mean that you always know the maximum amount payable to 1st lender.0 -
Presume you acted via a solicitor? Did your solicitor not serve notice on the prior mortgagee?0
