Can you find out how much money someone owes on their Mortgage.

  • Also as far as forcing the lender to re-possess it would be difficult and costly to you. You can take the individual to court and register a charging order absolute against the property which would make life difficult for the mortgagee but may also cost you to apply it. Definately worth checking with citizens advice or a solicitor

    Hi Clair.

    Typically it was ABOUT 2004. Now I'll have to drag the paperwork out to find out exactly, and since we just moved house and OH deals with 'anything paper' It may take a while.:)

    wow!

    This is news to me as I owe a credit card comany £4k and they have registered against me property (few weeks back). Now I am due to remortgage in June and wanted to change lender and at the same time borrow extra (to buy the last 25% stake of my shareOwnership home). Does this mean that I will not be able to do so if I change lenders. Also, if I stay with my current lender and remortgage whilst borrowing more, will they CC company have a say on this?

    if you wish to remortgage then yes the new lender will need to have permission from the CC company. if you are staying with the same lender and simply switching deals then no permission is needed but if you are having a further advance then the CC company will need to be asked to give their permission. you could always borrow the 4k you owe the CC co if there is enough equity on top of any additional borrowing therefore clearing the seocnd charge.

    i will no doubt be corrected if I'm wrong but I don't think that you need worry.

    i think that what happens here is that, provided there is enuf equity in your home the new lender can lend you the amount you require but they will also be obliged to pay off the cc Co.

    You then end up with a Mortgage for the amout plus £4000

  • yeah but mortgage lenders will be relunctant to lend you the mortgage one they find out that you have a registered interest on you home by someone else? Even adverse mortgage lenders wouldn't touch you!
  • Rizla01, have you tried contacting the Land Registry? I think they will charge you about £2/£3 to give you a copy of all charges registered against the property. Although I can't remember if it's just the name of the charge holder or if it also includes the amount owed. Worth a call.

    hsgamboy, unfortunately your credit card company will have had to seek a court order (usually means a CCJ is registered with Equifax/Experian) to register a second charge over your property. Changing lender will probably be out of the question if you want to remain with a high street prime lender.

    Has anyone managed to remortgage whilst having someone else registered an interest on your property? As the other person rightly pointed out, their is a CCJ registered against my name. I have the money to pay the CC company without the need for raising the cash by re-mortgaging, but I am only willing to do so with what I owe them and not the illegal charges (Have started to claim back the charges - to be taken off the overall amount they are demanding).

    My re-mortgage is due end of May so hopefully I should be able to get the registry on my property lifted off but unfortunately the CCJ will stay for 6 years.

    I will give you a breakdown of my circumstances to help;

    Expense;

    Current mortgage = £362 (own 50% - mortgage owing = £58K my share of the property is now worth £85K - that's an equity of 27K

    I also pay £166 service charge/rent on the other 50%

    Overdraft of £500 (will pay this off before May)

    No other debt to pay back!

    Also have to household expenses!

    I earn £29700, £2000 (child benefit, child tax credit), wife earns £14000

    Current savings = £9K

    As mentioned, the borrow is worth £170K, I want to borrow £140k - £145K with a £27K - £30 deposit

    The entry on the register does not give details of the amount of mortgage on the property.
