speed camera advice
Hi,
I got a speeding fine through the door this week - I was photographed doing 51 in a 40, so just wondered if I could get some advice.
First of all, I know I'm in the wrong for going over the limit, and it will make me more careful in future, but that particular stretch is a dual carriageway and it's really easy just to creep over the limit.
The thing I wonder about is that the van was out of sight hiding up a lane and the camera was mounted on the pavement. Is part of the thing with speed cameras not that they must be in clear view and not hidden away, so they're acting to increase road safety as opposed to just generating money through fines? Just wondering if there might be a way out of this

I was caught at 62 just as the dual carriageway merges to one lane and drops from 70mph to 50mph. It was the first time i'd driven that road (new job). Everyone driving like c**ts, trying to stop people on the right hand lane merging in turn, you have to think on your toes and I chose to brake late and merge safely, instead of slam on the anchors.
It's a popular little spot for the Talivan, it must really rake in the cash on that stretch of road...... Unfortunately, there's nothing you can do, just pay the stealth tax and get on with it.
I only ever really watch my speed like a hawk when im on dual carriageways with daft speed limits. The chances of finding the Talivan anywhere else are so extremely remote....
In fact these days I take the little country lane next to the dual carriageway, it's a lot quicker (60mph) and no risk of losing the licence.“I may not agree with you, but I will defend to the death your right to make an a** of yourself.”

Sadly in your case not.0 -
I don't think you have a proverbial leg to stand on, however there are far more knowledgeable and able people on www.pepipoo.com that will advise you on your chances of avoiding the fine and points.
(not that the people on this website are not knowledgeable and able of course;))0 -
Hi IanHi,
The thing I wonder about is that the van was out of sight hiding up a lane and the camera was mounted on the pavement. The requirement that detection be carried out visibly went by the board in April 2007 when the old funding methods for safety camera partnerships were superseded. In effect they can now do what they like in terms of location and hiding away. In Derbyshire the police have been known to use what looked like an old painters van whilst in North Wales they have hidden a camera in the back of a horsebox. This will not in any way negate the fact that you are alleged to have been doing 51 in a 40.
If you have not attended a speed awareness course in the last three years then at the speed alleged you are likely to be offered one (assuming that the alleged offence occurred in England or Wales - no courses are available in Scotland) provided you return the reply section of your Notice of Intended Prosecution within the 28 days permitted. My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

Why didn't you tell the police everyone else made you speed?
Show them the camera footage, they would no doubt have agreed it wasn't your fault, and prosecuted the motorists you tried to carve up.0 -
Cheers for your replies folks - I thought it was a bit of a long shot!0
