cc debt to mortimer clarke

Hi, I had a HFC credit card and was taken to court in 2009 for the debt by Marlin/mortimer clarke/phoenix recoveries - I currently owe about £4700 to them, a judgement was made in court in 2009 saying I must pay £25 a month, I have never missed a payment. Thay have today sent me an income and expenditure form to fill in saying they would like to see if i can increase the amount, they say that if I fail to increase the amount they may take me to court to see if the court will consider an increase, they also say that the court application costs will be my responsibility. They also mention applying for a charging order. I would like to know if I should fill the form in or just leave it. ( If I filled an income/exp form in it would not look like I could afford more as my debts total about £36000 and every other lender accepts a pro rata payment)

  • I take it that its a CCJ.
    If you are making payments of £25.00 stick to them!
    If you give them evidence you can afford more, they may use this in court to up your payments.

    I have had ccj's myself, you dont need to send income and expenditure form back.

    You could contact the court where the ccj was issued and tell them you cant afford more.

    But I do recommend you get some advice and call payplan.

    ITS FREE and the advice is priceless, in my view!
