Ebay Faulty Item Help

Hi,

Last week I won a SNES console, with games etc.. for £36.
Contacted seller beforehand to see if collection was ok and he agreed, cash on collection.
Collect friday just gone but had my son with me who it is a present for, it was bagged up and covered so he wouldnt know what it was.

Now, as he has been with me all weekend I havent been able to test it but today, after he left for school I plugged it in but it has no power :(

I have checked all over and re checked everything, cables etc... but nothing.

I have contacted seller, nicely to explain that it isnt working and I could only try it out today.

I appreciate its still early days and he may be honest etc.. but where do I stand if he isnt.

I am panicking as I have recently split from OH and funds are mega tight, cannot afford to lose this money, hence my impatience.

Cash on clollection - Not Paypal (stupid me!!)
Didnt see it working when I collected - (again stupid me, but had son with me!!)

What steps do I take if seller refuses refund or to at least check console?

    Cash on Collection was the correct method for the seller.
    I'm suprised if the seller wasn't expecting you to see the console working as he said it was ok to collect.
    I think you will be ok when you have made contact.

    He has sold another one and good feedback left, which is why I didnt think there would be a problem. Hindsight is a cow lol.
    I offered COC too, well I asked if he would prefer it and he said yes, thats fine.

    Phone seller, see what he says, if he isn't willing to refund then come back and ask for more info.

    Hi, thanks.

    I didnt hear for a few days so I took to buying another console, another sob story there :(

    Anyway, seller eventually responded and said he did check it all before he gave it to me and to try a few different things and if still no joy he will refund.
    In the mean time I recieved my other console (this story will follow for more help!) off i went to plug it in and didnt turn on, I took both consles to the local retro shop and it turns out it is the Power supply thats faulty. Both boxes work fine, have emailed seller and he has agreed to a refund for the cost of a new power supply (approx £12) but will need to wait for him to get access to a computer. If I have heard by tuesday I will try escalate the claim, Is that a good idea?

    As for the other console....

    Recieved Thursday morning, in a bubble wrap envelope. Open it up and the box is cracked in different places - had it been a small hardly noticable crack I may have not been too bothered. However there were several and very noticable, albeit on sides and bottom and 1 small bit to the front, top was fine.
    I contacted seller straight away and told him, basically he replied ranting about the post office but that was all. So I replied asking what he will do about it (all this was said in more detail) as it was no good to me as a present now. I offered to take pics and send them and he said yes, fine. I have done that this morning and he has said thanks, will see what I can do. I explain that Royal Mail take up to 30 days to respond so will need to sort between us now. I said I was happy to send back and make a claim through Paypal or Recieve a partial refund, if a decent one and keep the console as a spare. And said I would leave it up to him. He has come back saying that he cant refund anything unless royal mail compensate him - this is not true!! I have said that I cannot wait that long, that it his duty as a seller to rectify the problem, I said I didnt blame him at all but of course I shouldnt be left out of pocket or with a damaged console which I didnt expect to get. I have been a bit firmer in my last message, saying that he needs to sort this out and as soon as possible but still in a nice way.
    I have now recieved a message via my hotmail saying this -

    hello.. i got an idea. contact ebay and tell them i wont refund you. open a case i decline the refund due to it not being my fault And ebay should refund you. i know people have done this b4 when items i have sent have not turned up... i said this through here because i dont trust ebay and them reading my mail.
    ps.. i know that the post office did that on perpouse. because yours got sent 1st class.. i dont send 1st class i said to you it would be with you on saturday.... but my point is the woman who served me asked if i want it 1st class i said no but she still did as a 1st. and i got abit !!!!ed off she was trying to make me pay for 1st class. i said im not paying you. and had an argument with her. then i paid and she gave me 50p back .. And thats how you got 1st class.. and i cannot apologise enough.. but it wasnt my fault.

    Hmm, I dont understand why he cannot just refund me if I send it back and claim through Royal Mail, could it have something to do with -
    Item BIN - 99P
    Postage - £12.00

    Is he reluctant to make a claim as postage was only £4.XX
    Im not sure if he can only claim the 0.99p+ postage he paid or the full Ebay price.

    I assume he is telling to open a dispute and he refuses refund but does that mean I get one from Ebay, are they likely to say he is right and refuse my claim? Is it better for me to make a claim through Paypal?

    Sorry for going on and switching problems!
    All this has totally put me off Ebay!!

    After telling seller that I wasnt happy about all this and that if Ebay decided not to refund me then I didnt stand a chance of getting a refund he has sent me this -

    I think ebay will sort you out.. they make enough money off me alone :) . ok if you go to the item i sold you and click on the drop down menu you should come across resolve a problem. and then from there its fairly self explanatory with a bunch of options,. what you need to state is that is that im not refunding because the post office broke it and not me... and ebay should fix it. dont give them much details.. simpler the better really. and you should be ok. im just trying to rememeber if i have been in this situation and ebay refunded me...hmm i dunno. give that a shot anyway and see what happens. u never know you might end up with a refund and a machine..

    open a SNAD and return the item via trackable means when ebay tell you to, you will get your refund upon delivery and what happens to that seller isnt your problem,
    he sent a snes in a bubble wrap envelope, its his tough chit for crappy packaging if he makes a loss

    not sure on the first one how it would work payin COD, someone here will be along to help though x

    As above, open a SNAD case for the second console and make sure it's returned with tracking.

    As for the first console, you have no buyer protection when you pay cash on collection as you have a chance to inspect and test products when collecting.
