Landowners damages would most likely be zero, therefore the most the landowner can sue you for is zero. The PPC can't sue you for anything, they only want your money.0

Who said I was going to pay anything? In fact I have said several times already I wont and the very first line of my letter is a direct refusal to pay - If you are going to comment at least try to read what you are commenting on !!!!!!......
There has been a number of different views expressed on here and I am grateful for them all but having considered everything I have read and the personal circumstances that are specific to this case (I have had to spend a lot of time convincing my recently bereaved mother not to just pay the charge so it goes away) I have decided to send a single letter making it clear I will not pay and after that I will wait for a summons which I understand will likely never come.
Frankly I am surprised that any of those of you who have got so bent out of shape about this do not consider think that that this company is MORE likely to pursue an elderly widow who has written them a pleading appeal letter already and who they understand lives alone, than if they receive a robust response and a direct refusal to pay using the template provided from THIS SITE!
This is my last word on the subject. Thanks to those of you who have tried to help. Doubtless there will now be a couple of cyber-hooligans who will now make some kind of comment safe in the knowledge I have said I won't be responding again..........

If you really, really, absolutely have to write something because ignoring it is too difficult and leaves you feeling unsatisfied then at least don't supply these coves with all of the ammunition your mother might just have to use one day. Have you heard of the expression "Keep your powder dry"? Now's the time to be doing so.
Keep it short and sweet. Something along the following lines:
Dear Sirs,
Re: Parking Charge No: XZXZXZXZ
The above ticket was issued to me by your company on 12th July 2011. I will not pay it for the following reasons:
1. I had been granted authority to enter the area which had not been qualified in anyway, shape or form with regard to the necessity for payment or the obtaining of a permit.
2. I saw no notices on entering the car park nor at any time prior to my leaving it and did not therefore enter into any contract.
3. There was insufficient signage for my to have entered into any contract in any event.
4. The foregoing aside, had a contract been entered into the charge you have attempted to levy is completely disproportionate to any loss you or your principal may have suffered as a result of my having parked. I draw your attention to the fact that the total charge for a 24 hour period in an adjacent car park is just £7.10.
I look forward to your earliest reply confirming that you have cancelled the charge being sought.

I'd almost guarantee that your mother will get a standard "appeal refused" letter in reply.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

Frankly, I am suprised who are ignoring the regulars who know a lot more than you though. The evidence is clear, the less contact with the PPC the better, they'll use anything/everything you say against you, and contacting them will only make it more likely they will hassle you more (Robust response or not), and makes it more likely they'll do court (It's still extremely unlikely either way).0 -
The template letters are ancient (3 years old?) as is often the case on a large website. But in contrast, this forum is up to date to the minute and with lots of experienced posters who have been in your shoes - so that's why we advise to ignore the whole thing (or, if you feel you have to write, send a really assertive 'cease and desist' letter, not one with appeal points)..
Martin's article is out of date and - understandably - he does hedge his bets by saying 'most' fake PCNs are unfair and you 'can ignore but you may like to reply saying I wasn't driving'...
Thing is saying you were not driving does not stop the letter chains. And after the Freedoms Act comes in it will not help the matter at all as the registered keeper is going to 'have to' name the driver it seems.
Not that it will affect fake PCNs already issued. Not that this fact will stop PPCs pretending that it does...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I agree with your assessment, as far as it goes but we are all entitled to express our opinions within the confines of the forum rules.Advise is just that, an opinion and the op is perfectly within his rights to ignore. As far as the op is concerned, you and the other posters are nothing more than well meaning "bar room lawyers" . So unless you are an "official" expert be prepared to have your ego dented when your opinion is ignored as I'm sure you would be the first one to run and hide under a leaf if by chance (yes I know,extremely unlikely) the parking company did take his mother to court. The OP has received solid advice. He may take it on or not as he sees fit but I seriously doubt that the advice would have been any different on pepipoo than it would here. In addition, the OP has access to exactly the same "official" expert advice, as you describe it, here as he would on pepipoo albeit that there may have been fewer less expert views expressed along with it.

Advise might have been the same, but from a more trustworthy source.
The majority of the posters here have never been in the position of the op and are handing out second hand advice creamed off other threads.
Many of us HAVE had invoices from PPCs and also post on pepipoo.
The OP's case is not special or different from any others, and by writing he is only going to encourage the PPC to write more letters. If he can't ignore the latest one, what's he going to do about the ones that are yet to come?0
