Buying house solisitors questions!

hello,my brother buying flat as first time buyer.offer benn exepted on 13 october,survier done after 2 days.but after broker called hin and said that he has to pay another 10%deposit so in total 25%,which of course he dont have.she did calculation base on his income wrong,and lender need increase deposit.after we went to different lender,it failed also.my brother brought his latest payslip and letter from employer that his salary rise in november,it been asked by broker,so it took about 1 month.when agent asked which solicitor we use he said one in the high street(local).but after when the process took so long,and lender been waiting his latest payslip with his salary rise and his guaranteed overtime.finally mortgage offer been offered and bank ask my brother to use solicitor base in Manchester,my brother base on London.he just followed bank advise and chose one in Manchester.When he called agent he started shouted at him and say that he send all paperwork local solicitor.and he been surprised why solicitor even not start searches,and why from Manchester 300miles away.But my brother first time buyer and he just followed advise what broker gave him,also he was not sure if the case will go ahead and will bank lend him any money.Agent knew this and just wait,now not sure do he has to take any local solicitor can it cause delay as soliitor is far.?or leave as it is.pls urgent advise.thanks

    he can use any solicitor on th elenders panel and there is no massive benefit in using a local or remote one.

    I am guessing both the broker and the estate agent get a fee for introducing people to solicitors so will both say theirs is best.

    Your relative should go with whichever he prefers but should get a bloody move on as he's been messing his vendor about for ages while he sorts his loan!

    Yes,I know that it been long time since offer been exepted,but that was not his fault ,he been honest and told the vendor that he can not take loan even after surviy been done.lender need more evidence of his income,even agent said try different lender so we did,and it was failed also,so we have to wait only for previous one,and we didnt know that solicitor can start search,without offer been exepted.he paid deposit for solicitor in Manchester but not sure now if it cause delay because of distance.also solisitor did not start any searches yet as they waiting all paperwork from seller solicitor.and we dont know what to do maybe use one who allready has all details,I mean local one.because agent was rashing and he send all paperwork to local one,without my brother confirmation,that yes def,I will use him.But after when offer been exepted bank say we want YOU use Manchester one,and my brother scared if he say no they again can refuse his loan,as we dont know what the legal proccess are.But when we called same day agent and told him that offer exepted,and gave him solicitor details he was shocked,that nothing has been done yet and said why we changed solicitor,but we never have one,1,5 month ago when he asked which one we use we just say we might use one in high street,nothing else,its not our problem if he send all details to another firm,and he knew that it issue with loan as well.MY question is Is it gona effect process because solicitor far?and who was fault my brother,lender who first has to check everything after send survie(brother paid 365 pound),or estate agent.?thanks

    If yopur borther has committed to using 2 different solicitors then it is his fault,

    But has he actually engaged them formally? He would know if he had a letter outlining the terms of business.

    Please brak up you post into paragraphs - it is very hard to read and understand.

    A buyer can (should) choose their own conveyancer. Agents etc get commission from introducing conveyancers but the buyer does NOT have to use these.

    However whichever conveyancer he chooses must be acceptable to the mortgage lender (on their 'panel') or the Lender will appoint another solicitor to arrange the mortgage (which means paying two solicitors). Most solicitors are usually acceptable unless they are small (one-man) firms.

    So choose one, check they are acceptable to the mortgage lender, and then INFORM EVERYONE INVOLVED (mortgage lender, agent, seller, seller's solicitor, surveyor...)

    Ps I would go with the solicitor the lender wants, much less chance of it going awry then.

    I did my last house purchase by post, had to get my ID verified and sent off for money laundering purposes but I never even met my solicitor. as long as they are in the same country ie not buying a house in scotland, no worries.

    My brother never had 2 solicitor,he just said he might use one in high street.
    Agent straight send all paperwork to local firm which my brother mentioned before,but no one contacted him.
    After this hassle starts with banks,noone wants to give hime any money,only previous bank,but they needed more evidence from him.
    He told everything to agent,but agent never took out flat to the market again,just waiting responce as we are from bank.
    When offer been exepted bank recommend to my brother take their solicitor.
    he phoned the agent with solicitor details and agent was upset and shouted that nothing started yet.
    But how we can start if we not sure if bank will let or not.
    Now brother paid deposit to the Manchester one but still confused go ahead or go to the local one.
    Hope now more clear.

    The EA will have to resend the info already sent which in fairness is not a huge task. He's just understandabley annoyed it is taking so long - your brother really shouldn't have been offering before his finance was sorted!

    Yes I know that,but still lender gave him agreement in principal and send person for valuation.My brother paid 365 pound,and only when valuation report came he had phone call from lender that they an not lend him.

    well, that is the lender's perrogative and an unfortunate expensive side effect of house buying.That's lost money now.

    And possibly that he won't be getting his kick back, sorry commission, from the local conveyancing firm if he was the one who recommended them to your brother.
