One very important question that everyone seems to have overlooked.... how much do you earn? Also, a rough guess at how much your colleague (who is also not registered) earns would be useful!
I ask because there are certain cases where an employer does not HAVE to send a P46 in to HMRC at all... in cases where earnings are below the LEL, and from the only source of income (ie no second job) and an employee has no YTD from a P45 then an employer has no requirement to notify HMRC that they are employing this person until year end when they would submit a P38a instead of a P14/P60...
Current LEL is £101/2 pw (or thereabouts).
This is normal/totally legit and so would be no cause for concern if this applies. BUT - you are still entitled to a statement/breakdown of pay if rquested

Update
I have asked for the PAYE information and was told that they will send the payslips however my manager said that he does not know if they will be correct. What hell is he talking about if they are paying the tax it has to be correct.
My colleagues who has been working there for ten months called the tax office and they told him that they have no record of him paying tax at our company which is the same thing that they told me last week.
I cannot believe the mess that I am in.
Phone HMRC and let them deal with it. They are open now.0 -
My basic salary is £22,000 plus commisson and bonuses and collegaue is on about £30,000.

Its defo not on then.... they should follow statutory rules that say you should be provided with a full payslip, showing monies earned and clearly showing the amount of Tax & NI deducted for each pay period.
They had 56 days to process your P46 (or P45 for others etc)... call the employee helpline on these details...
8.00 am to 8.00 pm, Monday to Friday

Tell them that you do not have the PAYE ref as you have not been provided with it despite requests. Tell them how much you have been paid (so they'll realise its not a below LEL issue). Tell them you suspect that PAYE is not being operated correctly and hopefully someone will deal with it for you. Failing that (cos HMRC helplines are sometimes carp) you should visit your local tax office during opening hours and ask to speak to an officer.:beer:0 -

Just in case it is an error on your employers part I would say something like ' HMRC do not know I am employed by you, please can I have a copy of my P46 which I signed?'
But it does sound decidely dodgy imho at the mo... also tell them you need PAYE ref for HMRC to look into your own tax affairs... if they are just sloppy at operating paye/issuing payslips they may realise that they need to pull their socks up; if on the other hand they are paying you, not declaring employees and keeping tax & ni for themselves I expect thay may make more excuses at which point I'd be contacting the compliance team at hmrc who deal with paye fraud....:beer:0 -
