can council take a debt back?

    im going into town tomorrow to jobcentre , council office is near..do you think if i walked in there and asked to speak to someone about this so i can pay it in full it would i be able to do this.

    also i have to contact the bailft on monday as he has given me till monday to get as much of the money together. what do i do about him? im scared if he comes again he will hit another charge on.

    Hi again sorry for the delay I have been out.

    If you call at the Council who knows? If the officer is brave they may wish to see you in person, if they are scared they may think you have come to sort them out being the nature of the situation. I would call to start with, you have all day in theory to get hold of someone there. I would call first thing as soon as they open ask to speak to the Department Manager, Group Leader, and then put your case as we have discussed. I would also write a letter in preperation and then either send this to them first thing by handing into the reception or in person if you are going to see them.

    I would also call the bailiff and explain what you are doing and why you are doing this, I would also write to the baliff and explain this just to be very sure. If you are talking to anyone on the phone make a note of the time you called, the number you called, their name and what their position was, also request that they make a note of the discussion on your case so that you can refer to this later.

    If you have no luck by midday then you may need to look at a new plan of action, however post back and let me know whats what and I will try to help if possible.

    Just to confirm did you get your Postal PCN? the Charge Certficate and the Pre-debt letter from the Council? This is very important. If you did get this please tell me why you ignored it as you could have saved a great deal of bother for yourself, even if you could not pay ignoring will NOT do the trick, Councils do offer payment plans for JSA or other related benefits. Do proceed and may the max you can to the Council ASAP.

    Im sorry if i have missed out any information , my head is literally spinning with worry.
    im 99.9% sure i did not receive a letter saying i had PCN. If i had i would have tried to sort it out. The first i knew of it was when i had letter from bristol and suitor. Which I then contacted them and arranged to pay £25 a fortnight as they wouldnt accept any less. I was struggling to pay so emailed them as it was late at night and I was worrying over it , to say I wanted to discuss a payment plan which i could afford. The next thing I knew was the bailifts came round.
    I admit I have previously been foolish and have ignored letters but I have learnt from this and know not to ignore things like this.
    Eg , I was struggling to pay for the water , so contacted company and they took it out of my jsa.
    I have already got money being taken out by council as i fell behind with my rent when i had a job.
  • The incident apparently happened over a year ago they caught the registration plate on camera but I then sold my car in november 2010 so it happened before november 2010.

    Worse case they send you to a magistrate who will see you are struggling and you will pay them a tiny amount monthly.

    my friend has managed to lend me £100 in hope of paying council tomorrow.

    how would i get sent to magistrate... if the bailift comes in , he will remove my items and get his payment that way?

    Would it not be best to pay considering the bailiff has been in once.

    I would simply go to the Council as I have said in my previous post, OP I appreciate that you are not fully aware of the circumstances but I am sure that you would remember these letters as they are very clear and state that the charge will be passed to bailiff. I am unsure what you mean when you say you have arranged to pay the bailiff, did you pay anything to them yet? Have you agreed to pay them?
  • I still stand by saying do not let the bailiff in, yes I agree with the last post, however letting them in is even worse!.

    You will not have to go to a magistrate if you follow the steps that we have discussed, if all else fails go back to the original arrangement and arrange to pay bailiff should this be what you want to do, I expect that you do not want goods removed at all costs.

    If you need advice on bailiff you could ask in open forum on specifics, I am no bailiff expert as this is not my thing. I do know Council and Decrim Enforcement. HTH
