over two years ago my wife said she wants to end the marriage. for the past 2 years she been living in the house pending its sale. She works part time but wont declare to me how much money she earns i belive she should pay half towards the bills. I am paying all the house bills still and want to know if i have rights and if she should contribute more than £70 a week

we have a 16 year old daughter who wants to live with me when we move home. My wife is constantly swearing an abusive to both me and my daughter. and she threatens me saying saying i have to look after her financially is this true. ?

She also says because we moved from a council house which she had maxium discount she has the right to 60 percent of the equity, our old flat was 102 but with the discount it cost us 56 we took out loans to do the place up so we have a 98k mortgage i have paid all the bills for the last 15 years. all my wage goes on the bills i have nothing left and she is out every weekend partying can anyone offer any free legal advise i want to avoide court because i love me daughter and shes been through enough already

    Dude go and see a solicitor, as the responses you will get will maximise people taking you for a mug, only the legal channels may come up with a fair resolution :o

    local CAB should be able to recommend a solicitor who specialises and/or doesn't charge the earth, also you may qualify for legal aid - ask. Also CAB might have a solicitor who does pro bono work, ask again. But you DO need legal advice. If nothing else, to learn enough about rights and responsibilities to be able to get your OH to sort it with you through Mediation.

    It's complicated - most solicitors do the first 30mins of advice for free. In the UK generally there is no requirement for a husband to pay his ex wife any maintenance, only child support if she is keeping the kids, which you are in this instance. I would have thought it works both ways, and she would have to pay you child support if you have your daughter the majority of the time.

    As regards the house, solicitor. Many will accept payment once the divorce is finalised and you have your money from the house. It's unlikely she would get over 50% if you have your daughter and have been paying all the bills.
