need advice

hi everyone,i need a bit of advice,my husband left me in july,been having an affair since last chrismas.and he isnt paying anything towards the mortgage,and i am really struggling now financialy he wont sign divorce papers, wont go to mediation,wont cooperate at all.the house is on the market and he is refusing offers, so im wondering if i could get a lodger to help out with my finances,could he object i dont know where i would stand.i have a spare bedroom,what a mess he has left.

  • is the home in joint names? He should be contributing to the mortgage if it is- its a joint asset and therefore should be contributing to it. Or will he be agreeing to a lesser % of any equity once sold due to you having paid mortgage alone for some time?

    Have you sought leagl advice about lack of financial commitment to mortgage and refusal of offers? Why has he refused offers? Too low etc

    I assume you could take in a lodger and IMO the term 'what he doesnt know wont hurt him' springs to mind. Ask your solicitor to check from a legal POV

    Is extra hours/extra job not an option in the short term? Or calling mortgage co and trying to lengthen the term/go interest only until home is sold?
  • hi yes its in joint names,im working all the hours i can get and,i have already got interest only paymentsfor 6 months,dont know what will happen after then.i am taking legal advice,but its a slow process as he wont reply to any letters, and i also have to give him access to the house and keys,he turns up when he wants, pretending he wants his things but he took everything when he left there is nothing here of his now,so i suppose having a lodger is really out of the question.he doesnt have any keys,dont think he realises he can have them.thanks for your reply.
  • The thing is if he wont contribute to the mortgage and you cant afford to pay it then you both loose out - your credit report will be in tatters and the house will be repossessed (ok a long way down the road from now, but if you cant see a resolution it must have crossed your mind?)

    Maybe getting your solicitor to write to him to inform him of your intention to get a lodger may jerk him into action? If he disputes the idea he will ahev to respond, if he doesnt respond hes accepting the idea?

    have you checked if you can get your solicitor working for you under Legal Aid? Ask CAB for advice on this (solicitors prefer you to pay as they can charge higher rate, some solicitors won't do Legal Aid work).
    The questions that get the best answers are the questions that give most detail....
  • hi mgdavid,i have applied for legal aid,and shouldnt have a problem with that i have also applied for the bailffs sevices,only thing is, i dont know where he is, and the bailiff isnt allowed to go to his work,he cancelled his direct debits for his loans and credit cards,the banks were sending letters here,i redirected them to his mothers house and they have been returned not at this address.he trys to bully me by text occaisionaly,but have chosen not to respond to him.
