10 yrs with same company, been on 2 weeks notice for last 2 yrs!!

    Probably the firms main reason for the malarkey is to keep the staff on tenterhooks in the hope that steadily more and more of them will feel pressurised into applying for jobs elsewhere - just in order to get some certainty in their worklife.


    But the process they are using is actually doing the employee a favour because you are continuously within you statutory notice period.

    Get the job, counternotice, and then get the redundancy.

    Most probably don't know that so resign.

    The other thing I did not think of earlier there are probably a load of other claims you could make at the same time if they don't pay up and you have to go to an ET.

    Do you mean a 48 hour opt-out agreement? There's no "had to" with one of those. It's a voluntary agreement, and an employer cannot legally make an employee work more than 48 hours per week. He can cancel the agreement at any time, although there may be a waiting period before it comes into effect - this is usually seven days, unless it says otherwise in his contract.

    That being said, personally I wouldn't rock the boat by cancelling the agreement unless I was prepared to lose my job - an employee can't be dismissed for cancelling an opt-out agreement, but since they've already given notice, the issue's a bit confusing. But if your hubby is a member of a union and decides to take it up with them, it's something else you should mention.
