Issuing a CCJ

I have to issue a CCJ for over £4000 for goods not supplied to me by A vendor.
I can complete the CCJ form on moneyclaims online, but am unsure whether to name the individual or the business.
I think it should be the business as I paid the money into the business account, but need to know if this is correct before I submit the claim. I have a suspicion that the individual involved has set up a seperate business bank account in a similar name to the company he works for in order to carry out these frauds.
I have been to the police who say i do not have enough evidence for them to investigate this as a fraud.
I do not know if he is a sole trader or not.
Thank you in advance for your replies, and yes I know, i am a
bl()()dy fool for having paid in advance!

You would have to sue the legal entity that you believe you had a contract with.
If you don't know who your contract is with, then I suspect your claim is doomed to failure from the start.
Before issuing any summons, you should send a 'letter before legal action' to ensure the legal entity you claim owes you money knows about it ... so who did you send that to?
Finally, don't even bother wasting your time & money claiming money until (a) you feel you have a good legal basis for a claim and, more importantly, (b) you are sure the legal entity you claim owes you money has the ability to settle such a claim if after all the legal wrangling they are found to owe you the money.
Having judgement is one thing, but the end game is to recover the money owed and that is something quite different."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100
