That is what I meant, just didn't explain it clearly enough. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0

VICTORY! (Hopefully):j
After sending a rather irate e-mail to the general DLP customer services e-mail (rather than the merchandising email I had been using) stating I wanted to escalate my complaint and be put in touch with senior management, plus pointing out the UK ECC was taking up my case, DLP have now relented an agreed to exchange the toy.
The form DLP sent me to also said I could reclaim postage costs, which is the least I would have expected and also, as I understand, my right if the product was faulty.
Big Thanks to all who have posted. Woody is on his way to DLP (carefully wrapped and postage tracked - thanks for the heads-up Angelil). I'll post again when I get the replacement back from DLP.
I am still going to let UKECC investigate whether I am entitled to this exchange under the EU Directive as I would be interested to see what my position is legally. Again, any info gained will be posted here.0 -

That's great news. Please let us know what you are told by UK ECC, it would be helpful to have some reference for future issues. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -
Good

Just so you all know DLP is owned by a private equity group - NOT Disney. This is why DLP is not as good as Disney World in Florida as the equity group focuses on profits to the expense of even keeping their park clean and their customers happy. This also explains why they are trying to prevent you returning the item. And for this reason they may not be able to have the disney stores swap the item for you.0 -

They operate the park under licence; a franchise, if you like. That should not affect anyones statutory rights. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

You are not entitled to your postage costs at all, so fair play to them if they are agreeing to refund them0 -

Why not?
