Council tax experts?

Would anyone know if someone is allowed to claim the 25% single dwellers allowance on 2 properties, in 2 different areas.

I have 2 flats at the moment, and i'm living between both, on my own. One of the councils just started being a bit strange about it, and I would like to know where I stand.

    One 25% discount only. The second home may be able to get 10% discount.

  • You only get 25% Council Tax on your main residence so you'll need to decide which flat that is if you divide your time equally between the 2.

    The other flat will be classed as your second home & the local council for that property is responsible for deciding what amount of second home discount. if any, you can get.

    Bear in mind that there are Government discussions going on whereby changes to second home council tax discounts may alter.

    The councils will be rightfully careful before awarding discounts in cases like this - I've seen loads of similar cases where people have actively set out to defraud the councils as its easily done.

    As has already been mentioned a Single Person Discount can only be claimed on the property that's your 'sole or main residence' , on the other property you'll only receive a second home discount.

    The councils will likely want to check with each other before awarding discounts - before I moved to a recovery team I spent quite a lot of time on the phone chasing other councils for the discounts being claimed in their area.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
