So was the box sealed as it clearly states it includes all those extra items. If ti doesn't then surely you should be talking to the manufacturer who states all those items are in the box?
personalyl I would offer a full refund as I think you are likely to lose a SNAD claim anyway
Someone asked the question and OP replied:the easel is still in the cellophane wrapper and never opened and it will be sent in the original box
So to me the Easel was brand new and sealed, nowhere I can see does she state the box itself was sealed, just the Easel.0 -

But the buyer doesn't care. She saw brand new, still sealed. Saw the picture that included everything and bought it. The fact that the Op stated it excluded the items is moot. She could have put it in huge red writing that scrolled down the screen and made honking noises, but if the buyer can't be bothered to scroll down and read the description it means nothing, and she will have to spend the time and energy refunding them and selling it again.0 -

This is where the whole issue is grey for me because the Easel was brand new, unopened and undamaged still sealed in its original cellophane bag.
I do feel OP made a mistake in showing the box, but I also feel the buyer should have read the auction properly. They did receive a brand new, sealed Easel.0 -

I must admit looking at the title it could be seen as misleading, unfortunately when I listed the item I also listed about another 15 items and I think stress got the better of me (no excuse I know).
As stated in the answer to the question the easel was still in it's cellophane wrapper and the item was sent in the original box.

True, both parties made a mistake. Sellers aren't allowed mistakes when it comes to a dispute though

In short, people need things pointed out, pointed out, and pointed out some more.
I sold a dvd box set on there and put in the title the box was cracked, I took a photo of the crack to show it and in bold red text in the description said it was cracked .... a week a later i get an abusive email from the buyer saying the box is cracked ....
Unfortunately, Ebay automatically side with the buyer in nearly all cases.
Also I think its a joke that a seller can no longer leave negative feedback for a buyer.0 -
People don't always read, I would have assumed from the title & picture that the contents were included.
I would like to think that I would have noticed the bit about excluded items but if I saw it in the last few minutes of an auction, who knows.
I may just have seen the BN & sealed bit & bid without reading it all if it was what I was looking for.0 -
Oh, come on... it does state that items are exluded AND someone has asked a clarification question to double-check which items are excluded.
To avoid hassle, just offer a refund provided that they return the item.0 -
Tbh I thought is was a bit misleading. It shows the box that says the other things are included, so I'd automatically assume they were. It's no excuse to not read the listing, but I think you should refund on return.
I don't understand how it's new and sealed if there are parts missing though. Was the tin of 24 coloursoft pencils in a separate box ? The photo implies it's in the box, which you've said is brand new and sealed. So it's confusing, even though you've specifically said the pencils are excluded.
I've bought things without reading the description before, as when it says brand new and sealed I expect it to match the picture.0
