Barclaycard PPI

Sorry for the long post

I took out a Barclaycard and Mastercard in the mid 90's and took PPI at the time. When I went to claim for unemployment in October 2010 I was told that the policy was only for sickness and not for unemployment. I was pretty sure I would not have taken cover only for sickness, but could think of no way to prove differently.

Run forward to this year and in the wake of all the PPI news stories I made a claim on both cards last August on the basis that at the time I took the cards out my employer offered excellent sickness cover and that my main concern would have been unemployment.

A couple of weeks ago I received a letter accepting my claim and making an offer I was please to accept.

This morning I received two letters - one informing me that the funds had been paid into my bank and another (with a slightly different reference) telling me my complaint had not been upheld!

My initial worry was that they were going to take the payment back, so I called Barclaycard and was told that in fact they had treated the two claims separately and based on identical information one customer relationship manager had found in my favour and one had found against. I asked how this was possible and the very helpful lady on the phone could not understand. She asked if I'd 'ticked the box', something I honestly didn't know, then having checked my file confirmed that I hadn't. She then said it looked like a 'miss adjudication' and would refer my complaint for a re-check. As I have her name it could be interesting if they subsequently claim not to have the original paperwork!

I can't help but wonder if I'd not had a positive result on one card I'd probably not have bothered to complain and wonder just what percentage of claims are rejected similar to this.

One a further note the rejection letter made reference to the General Insurance Standards Code of Practice and that my complaint was not eligible for referral to the Financial Ombudsman Service. A call to the FSO this afternoon confirms this is not true and that they will be happy to take on the case should the re-check not go in my favour.

  • Interesting footnote to this. On the acceptance letter for one card the letter says - "We have been unable to establish whether you agreed to purchase PPI. Based on these findings we have upheld your complaint". On the rejection of the second card taken out simultaneously they make no reference at all to whether I agreed to take the PPI, they just talk in vague generalities and saying that they have "found no evidence of mis-sale". The more I read the second letter and threads on here, the more I tend toward the view that this is just a form of 'go away' letter which given Barclays claims of wanting to clear up the whole PPI issue is a touch disingenuous.
  • To update I have now received an offer for the second card for in excess of £16,000 so I'm pretty happy.

    Couple of observations from a newbie

    1. If Barclaycard had said no to both claims it's 50/50 whether I'd have go ahead and fought through the FSO and I would probably have believed their assertion that no miss-selling had taken place. I wonder how many other have done the same?

    2. In speaking to the FSO last week I as told that there is currently a backlog of approaching 12 month in appeals, so I'm pleased that route wasn't necessary.
