  • Nonetheless, until 6 months the onus is on the retailer to prove the fault wasn't inherent at the time of sale. My starting point would be to remind them of this, and warn them that unless an agreement can be reached, I'd be looking to pursue them for the associated costs (data loss etc) incurred as a result of their inherently faulty product.

    No, it's not a viable position to start from, but sometimes, being unreasonable gets results, if only to get you off their back.

    Any Orders that are over 6 months old and the Product has been confirmed to be defective and a refund is due, the refund will be calculated based on the age of the Order and you will be refunded a proportionate amount of the original purchase price of the Product. This does not include the carriage cost of the original Order which will not be refunded.
    As yours was less than 6 months old they are not following their own T&C's.

    Nope, it simply states what the rule is outside of 6 months, unless they specify elsewhere in the T&C they are following their T&C and the SoGA.
