In a right mess.

I was signing and getting JSA contribution based till last wednesday (but was due to end on the 16th Nov anyway) when I signed off as I had found employment. I started work this Monday.

I suffer from a condition called cluster headaches (never claimed disability for them) which have effected me all my working life, I have clear periods then bam they hit and leave me incapable of doing anything and really out of sorts for upto a couple of months at a time whilst suffering So this Monday evening I get hit by a headache and know that im in for a long stretch with them. I ring the employer and say im sorry and explain about my headaches and basically that im going to have to give up the job as im not certain on how long i will be off work, obviously im not happy and im pretty certain my new employer wasnt happy that after only 1 day id gone sick.

The point is, how will this affect my claim for jobseekers allowance now? I was moving off contribution based to income based anyway within a week or two. I know we wont be entitled to any money as my partner apparently earns too much but will my benefit get suspended whilst they look into it?

Would I need to do a "rapid reclaim"?

  • why did you give the job up before starting? I understand you got a cluster headache starting but couldn't you have asked to delay the starting date of work?

    I didnt give it up before starting. I had started work, but that night i had several episodes of headaches this in turn knocks me for six. i rang the employer and told them about my headaches ( the work was computer based, all day looking at a screen) which does not help my headaches at all.

    OP worked on the Monday, called the employer on Monday evening - so had started work.

    OP, I think you were a little hasty in giving the job up. You state that you aren't going to be eligible for IB JSA so does it matter if the JCP sanction you?

    Yes because I have mortgage protection insurance.

    I do realise its a bit hasty, but im pretty certain the employer wasnt too happy that after 1 day I had gone sick.

    My contribution based had ran out, i was about to claim income based JSA, I know we will not get any payment, im just doing it for my stamp.

    As I previously posted as im going to claim income based (to which i know we will not get any payment) will the jobcentre sanction me? And not pay my stamp?

    Thanks for the clarification. To answer your question, yes, the JCP may well decide to sanction you. If they do, then your benefit will be suspended.

    You might as well put in a claim; any suspension will take a while to take effect.

    Lots of information about the condition and newer therapies here- perhaps worth discussing with your doctor?
    I'd have thought that a job requiring hours of work on a computer might be an unwise choice as constant staring at a screen might well aggravate/provoke symptoms?
