before i speak to acas just thought i get some advice from on here.
Whats the correct consolation period from been told your are been tupe
,to having a 1 to 1 with new employer and then been transfered?
we have herd rummers of been tupe for around 2 months but no official meeting or letters.There was a meeting around 2 months ago where we were told that the sale of the dept had fallen through and that they couldn't tell us who the buyer was thats it.
I'am on sick at the moment with a broken leg so i got a phone call monday from my boss and a bloke from h/r saying the sale had gone through and that you will be tupe to the new firm.The new firm has a bad rep with in the industry and i don't want to go,which i tell my boss.I know that i may have no choice.
then today we get told we are having are 1 to 1 with new boss(which i carn't attend)where they will be presented with new contracts and that will we be transfered on fri 2/12!!!!
From start to finish this will only be 10 working days from been told of the tupe to starting a new job,is this a ok time scale?
It seams there trying to rush every thing so we don't get chance to sort any thing out.
theres 4 on the tupe list ones been here 1 year and me and the other 2 around 10 years.full time employees and none of us want to go due to the new company for been well crap!!!
the other lads are in the meeting at 11 today so have asked me to look on the net for any info

More than 20 people involved is 30 days, less than 20 doesn't seem to have a fixed timescale.0

You may well have no choice but to transfer. But I would be more concerned that you are being given new contracts, than the short consultation period, myself.0

tell me about it mate,i know i have no choice but it all seems abit rushed.The thing is the new firm is really bad they go through staff alot and have a really bad reputation.Also they pay there staff around £200 a week less,which i know they carn't lower my money but there current staff wont be happy when they find out.iam based near leeds west yorks ,but i think there wanting us to go work in north scotland?which also rises more issues.will find out more by 1 o'clock then ring acas.0 -
quick update
just got a call from a work colleague whos just got the the new firm.The transfer is happing today they want us to sing the new contract ,pick up are ppe,phones ect and new vans.
is this the quickest tupe in history? 3 days.LOL.0 -
My point was they can't require you to sign new contracts and especially not reduce your pay or send you to work in Scotland! How will the new contracts differ? I presume you are not in a union? And don't expect any shafts of enlightenment from ACAS.0

they have said are money ,time served ect will all stay the same,but i wont know till they come and see me at home.Its just the work location i think there trying to change but will know more later.No mate no in a union and my mate whos up there now has just phoned acas and they just said get legal advice and didn't really help.0 -
Well, unless you have a clause in your contract which allows them to relocate you, they can't force you to do that. You may feel you have no choice, but they would have to make you redundant if they are insisting on everyone moving and you don't want to go.0

they have said we will be based in there yard near bury which is around 1 hour away from leeds(within tupe distance) but my have to work away in scotland.(which is where all the work is)
Every thing contract wise stays the same but when my mate asked how long before your allowed to change any thing on are contract they wouldn't answer and just skipped the question.
how long is it before a company can change things like pay and working conditions?is there a set time period?cheers0 -
No there is no set time.
If they seek to force changes through, or dismiss you, for reasons linked to the transfer, then that is unlawful. Obviously the further away in time from the transfer you get, the easier it is for them to argue that there is no link.0
