Unpaid Rent From Dss

Hi everyone ,
havent recieved rent on our flat since october(council paying rent not tennent), needed tenancy agreement then due to the computers being down at there offices ,was told that it would be sorted at end of dec , then end of jan , now were told to wait 7-14 days!
Bearing in mind we use this money to live off and have had to orgainise overdrafts to get through xmas
are they allowed to get away with this?
is there anything we can do due to the inconvinience

    Are you sure it is a delayed payment and not "awaiting information"?
    Did they say should be paid or is going to be paid?

    1)you need to get the full info from the council, they may not give you full details so you may need the tenant to sign a data protection waiver, and then get all the info.

    2)as it is technically the tenants responsibility to pay the rent, the council will not pay any compensation at all.

    3) yes councils do this all the time, and don't care a jot.

    Phone the council and tell them you are going to start eviction procedures as the tenat is now over 2 months behind with the rent. Owing more than 2 months you will get any judge is bound to rule in your favour.

    Is the tenant pressurising the council? If you've got a tenant under a normal AST then the tenant is liable for the rent regardless of whether they claim benefit or not.

  • originally it was to do with the tenancy agrerement,then the computers going down came into effect and has taken 6 weeks
    thanks for your replies it has helped a lot ,they do seem a law unto themselves! oh well we'll have to keep plodding along

    Your being too patient. Tell the council you will evict this tenant as they are over 2 months behind with the rent and find a non-HB tenant. They have the capability to issue an interim payment, make sure they do it.

    get the tenant to contact the council as well. they should be worried that they are behind with the rent. are they contributing at all, or is it all HB funded?
