31K+ in debt Unemployed, no disposable income

Hi everyone I really need some help and advice, my life is in tatters and getting worse only financially but its affecting everything.
Almost Debt free!

    Running away is not the answer.

    You do need some professional advice from one of the debt charities, and might need to consider bankrupty if you do end up responsible for the whole debt.

    The RBS card doesn't really make a lot of sense as its written - when was the card stolen? when did you report it as stolen? surely RBS put an immediate block on the card? How did they know your pin? had you written it on the card? or written it on paper stored with the card? Over how long a period did they run up a £27k debt? How did they withdraw the funds and make purchases?

    Do you know who stole your card and who made the purchases? was it someone you know?

    First things first... NO debt is worth ending your life over - so stop those lines of thinking right now!
    Secondly - why exactly did the bank and the ombudman say that they believed the fault of the fraud was down to you not looking after your PIN? I'm very confused about how they ran up a £27k debt on a card with a £1k limit too... That really makes no sense to me. You reported the card stolen - how soon before/after did the thieves start wacking on the transactions? Time line might be important here...
    SHOULD the worst come to the worst... Going BR is NOT the end of the world - I agree it's not deserved if the debts aren't yours but are fraud, however if you can accept that it's not the be all and end all then I think you'll find that some of the stress will lift :)

    Running away to Australia is fine... IF you can get a work visa for out there... would you be able to get a sponsor and a job? Australia can be very expensive to live in so only really an option if you have guaranteed work out there...

    Apparently after I called to request a PIN Someone else had called to request my PIN number aswell, I think they somehow credited the card how, I do not know. Don't worry I won't let the !!!!!!!s grind me down to suicide id run away first! They may have got my card and intercepted my post, or someone I know overheard a bank conversation on the phone and got.my card and somehow my PIN. I never actually used that card for nearly 12 months then this had happened
    I would never get an IVA. I just want it all to Go away!
    Is there any point in me struggling to pay my other loan and credit card off now!

  • Can I suggest that you talk to the debt charity CCCS. From the very basic information provided, bankruptcy might be your best option but whatever the case, they can tell you. Are you Australian? If you are not then running away to Australia may not be the solution you think it is. Better to stand and face it. You don't need to be alone in this, theres help and support here. CCCS are very good apparently and bankruptcy isnt the end of the world - for some its a new beginning - so First stop - get some proper professional advice.
  • I think you need to take it step by step - you need to go back to RBS re the credit card - when did you lose it, have it stolen etc......go through every step in your mind - go over when you informed RBS it was gone, what happened next etc - maybe do some digging on phone bills to prove times and dates - if you hadn' t used the card for 12 months the CC company can see that - you can point that out to them - activity such as this should be flagged up with the CC company immediately - it would help to know a little more information on the circumstances of the credit card loss/theft to try and help you further and maybe point you in the right direction - secondly everyone is right no debt is worth doing something stupid for .......but it won't just go away....you need to instigate it going away so as to speak.... some further details posted here may help others help you - then yes go straight to the debt charities - they can and will help

    Couldnt read and run.I really dont know what to say that could help you.Have you got a breakdown of all transactions made on the card ?My friend had her card used in Australia but she could prove she was in the UK at the time,lucky for her the CC company flagged it almost straight away but only because she tried to use it in the UK within a couple of hours of it being used in Australia.My point is if you can just find one or two discrepancies where you can prove it wasnt you then surely they would have to investigate it further.Check all the CC transactions against old bank statements and hopefully you will find that you used your bank card in place A while your CC was used in place B making it physically impossible for you to be in 2 places at once.Really hope you find something and get it sorted.

  • amazing......how inconsistent.

    I thought they had to prove you were negligent with your PIN, which looks like you were not.

    I had an RBS C card that had a 10k limit and I logged in one day to see suspicious transactions (2005 I think). They refunded the 2K spent, even though it had been used to get cash out using the PIN. No idea how they got it, bur that was in the days before chip and PIN, its much easier to get now. It was obviously fraud as they were drawing cash out in France at the same time as the UK.

    So, do you have a list of transactions so you can see if there is an impossible pattern or prove you were elsewhere?

    If not ask for one. If they refuse, you could submit a SAR for £10.

    I would also try and find out what evidence they have that you were negligent with the PIN.
