Kicked off Incapacity....Need help.

Hi, in July 2010 after many tough times we (my husband and me) were advised to go bankrupt by Christians Against Poverty. This was a lot easier than we expected ( we had worried over whether or not to) and in january 2011, we were discharged. Basically there is no prospect of any improvement (health or financially) and the OR understood and agreed (she was a lot nicer than we expected) . Having received a letter from dwp 17/11/11 saying my benefit would stop form 18/11/11 (tomorrow) On Friday 18 November we were due a payment of Incapacity for myself and my husband, and Income Support for my 19year old daughter and her 1year old daughter. I had been told by DWP that while my daughter is in full time education that if she claimed herself she wasn't entitled herself but if i claimed for her she was (don't know how it works) and also the same applies to her daughter (my grand-daughter) . I phoned them on friday and again today (monday) but i have been told that we are not entitled to anything until the appeal is heard. Citizens Advice say i should get a crisis loan until the appeal, whenever that is, but regardless of my case (Arthritis, M.S., and more, hubby left work 15years ago due to Arthritis) can they leave my daughter and her daughter without money?? Apart from Child Benefit.

    Does your daughter receive maintenance from the child's father?

  • Why has your IB been stopped?
  • Can your daughter not get a job? Especially as she has two parents she lives with to help out with childcare from time to time.

    Was this a failure of your IB to convert to ESA, after you went to a medical?
    Did you miss any medical you may have been asked to attend?
    As I understand it, nobody should be being reassessed for IB at the moment, any reassessments will be for conversion to ESA.

    Normally - if you haven't missed the medical - you can on telling them you want to appeal, get paid the assessment rate during the appeal.

    No. The little b***ard is at college and not earning

    The idea was for her to go to college, then uni, then work.

    However, she got pregnant at college, apparantly her heart meds counteracted the contraceptive pill she was on (shouldn't the doctor know) and she got pregnant. Didn't realise until it was too late to abort (if she wanted to) and the pregnancy put extra strain onto her heart. Now her attendance is down, her grades are down, uni is (probably) out. We have no problem childminding, but with little strength and energy there aren't many jobs she could do

    That's it, a reassessment for ESA. We got a mixture of me and hubbys Incapacity and daughter and grand-daughters Income Support in one payment. Went for a DWP medical in August, doctor could barely speak english, when he asked me to do this and that, I told him I couldn't because it hurt too much. He wrote on the form that i refused to do anything he asked me to!

    So they stopped my money and i have to appeal. Payment was due on 18 November, but phoned them and not entitled to anything until the appeal is heard. Guy from Citz Advice said it could take up to a year, no savings so what can we do.

    She is entitled to claim support from the child's father.
