Hi, Got a diagnosis of chronic lung disease (IPF) 3 Years ago and i claimed disability living allowance benefits and got the higher rate on both parts and iam on the mobility car scheme. I have recently re-claimed dla, about 2 1/2 months ago when they sent me the forms, but they are still looking into my claim and will be for some time as they are waiting on notes from different doctors as i have got other things wrong with me and go to different hospitals. They said my money will be stopped on the 7th December when my claim runs out and then be back dated once my claim has been finalised. What happens in the mean time with the car, when my claim is still being look at?. I know all the money will be stopped and I will have to live on income support, which is going to be hard. Also if it is dropped down to the lower part what will happen when i appeal and what about the money and the car while appealing? Also how long do you think the appeal would take? My wife is a carer to me and our two kids and we know that the carers allowance will be dropped down as i have slightly improved by coming off the transplant list. Before my illness I had never had benefits before as ive always worked until 3 years ago so any help would be great. Thanks James

There are a few weeks - but only a few weeks grace about the car.
Talk to motability about what happens, the rules have recently changed.
If you're dropped down to a lower rate (or the award is removed), then you stay on that rate while appealing, and get the difference once the appeal is won.0 -
My wife was up for renewal. The DLA ran out, we lost carers allowance as soon as it did and the income support stops 8 weeks after and is paid at a lower rate during the 8 weeks. Now we are having to claim ESA and still no decision. I have a welfare advisor working in it but its like pulling teeth to get an award. We sent in doctors reports, consultant reports, occupational therapist reports, carers team referal letters
and still it drags on. The whole system is a mess.

My friend's son was in receipt of DLA and it was stopped last year. The car had to be returned immediately, even though they were appealing. It took nine months for the appeal, and the lad was awarded HRC and HRM, with the full amount backdated. The Carer's wasn't backdated though, and neither were the tax credits elements for disability and severe disability.
Carer's Allowance cannot be 'dropped down' as it is paid at a single rate of £55.55 a week.0 -
My DD has chronic lung disease..upon renewal her award was dropped from HRC/HRM to LRC/no mobility,had to go through a reconsideration where we got awarded HRC/LRM but on the advice of paediatrician/physio we are now appealing the mobility award.
Our car was due to go back on the 29th september but motability have extended the lease until march 29th 2012 whilst we appeal.
It seems to vary greatly from case to case as others I know have had to return their cars.Definately worth calling the lease extension team at motability to see where you stand.Good luck xSlightly mad mummy to four kidlets aged 4 months,6,7 and 8
